Article 1.

GENERAL

  1. Regulations define the terms and conditions for the operation and use of the service www.geoportal.gov.pl, (“Service”), including in particular the rights
    and obligations of the Service Users and the Administrator.
  2. The provisions of the Regulations are the exclusive basis for the aforementioned rights and obligations, with the exclusion of circumstances regulated by applicable laws.
  3. The Administrator of the Service, within the meaning of the Act of July 18, 2002.
    on the provision of services by electronic means (Journal of Laws of 2020, item 344), is the Chief Land Surveyor (hereinafter referred to as the Administrator).

Article 2.

INFORMATION SERVICES

  1. The Service publishes information of a public and publicly available kind.
  2. The Service makes it possible to search for information and to combine information from the resources of various providers into a coherent whole and to present it in graphic form
  3. The information presented on the Website, other than the materials of the state geodetic and cartographic resource, is for illustrative purposes only and in no way can it be treated as a document of an official nature. Neither can they be the basis for any administrative or official actions.

Article 3.

LIABILITY

  1. Information published in the Service in accordance with Article 4(2) of the Act of February 4, 1994 on Copyright and Related Rights (Journal of Laws of 2022, item 2509) shall not be subject to the protection provided by the aforementioned Act.
  2. Publication of materials from the Website is permitted provided that information on the source of origin is included.
  3. The Administrator shall not be responsible for the correctness and accuracy of the data provided in it.
  4. The User uses the information published on the Website at his/her own risk.
  5. The Administrator is not responsible for interference with the operation of the IT system, as a mechanism of the Service, resulting from unauthorized actions of Users, force majeure or interference of third parties.
  6. the User is fully responsible for all content posted on the Service, including by adding content by connecting spatial services, or adding content using the ‘Drafting’ tool. This includes, but is not limited to, data, text, images, graphics, and all other forms of information.
  7. The User’s posting of content on the Website is tantamount to his/her representation that he/she has all necessary rights, permissions and licenses to the posted content, including copyrights, trademark rights, and other intellectual property rights.
  8. The Administrator is not responsible for the content posted by Users, including its accuracy, legality, truthfulness, or compliance with any legal regulations.
  9. Posting any content on the Website is equivalent to the User’s consent to make it public and available to the public without territorial, temporal or quantitative restrictions.
  10. The User agrees that the content posted on the Service will not violate the law or the rights of third parties, including the right to privacy, copyright, or other intellectual property rights.
  11. Content posted by the User on the Service shall not contain illegal, offensive, defamatory, discriminatory, or otherwise inappropriate material.

Article 4.

MISCELLANEOUS

  1. The Regulations shall come into force on July 8, 2024
  2. The Administrator reserves the right to unilaterally amend the provisions of the Regulations at any time and without having to justify the reason.
  3. The Administrator reserves the right to leave complaints unprocessed if they result from ignorance of the Rules and Regulations or the provisions of applicable law.
  4. The Administrator shall not be liable for damages resulting from incorrect information posted on the Website. Liability for lost profits is excluded.
  5. Use of the Service is tantamount to a statement by the User that he/she has read the Regulations and accepts its terms.
  6. The content posted on the Service before the Terms and Conditions come into effect will be processed in accordance with the purposes for which they were introduced to the Service. The processing of this content is carried out in accordance with the law and the Terms and Conditions.

Consent to personal data processing

in connection with sending notifications or comments to the addresses indicated in the CONTACT tab is tantamount to consent to the processing of such personal data in order to ensure the functionality of the www.geoportal.gov.pl website, including in particular the handling of notifications and comments.
