Terms and Conditions for GeoChatbot Users on www.geoportal.gov.pl website

1. General

  1. This document sets out the Terms and Conditions for the use of GeoChatbot available on geoportal.gov.pl website, which is managed by Head Office of Geodesy and Cartography (GUGiK).
  2. GeoChatbot is a supportive tool for users who are searching for information and technical support on geoportal.gov.pl website.

2. Services provided by GeoChatbot

  1. GeoChatbot answers questions about the functioning of the geoportal.gov.pl website, services and National Geodetic and Cartographic Resource’s (PZGiK’s) spatial data and GUGiK’s activity.
  2. GeoChatbot does not replace professional consulting such as legal, technical or geodetic advice. All answers provided by GeoChatbot are for informational purposes only and cannot be considered binding.

3. Terms of use of GeoChatbot

  1. The use of GeoChatbot is voluntary and free.
  2. Users are obliged to use GeoChatbot in a legitimate way and respect public morals and third-party rights.
  3. It is forbidden to introduce to GeoChatbot illegal, offensive or rude content violating the copyrights and other intellectual property rights.
  4. The User undertakes to refrain from any actions that may disrupt the operation of the GeoChatbot, including attempts to bypass system security and the use of automated tools to send mass queries.

4. Responsibility

  1. GUGiK makes every effort for GeoChatbot to run correctly and provide reliable information. However, GUGiK does not take responsibility for the consequences of decisions made based on information obtained via GeoChatbot.
  2. GUGiK does not guarantee that answers provided by GeoChatbot are complete, accurate and up-to-date.
  3. GUGiK reserves the right to modify, suspend or cease the operation of GeoChatbot at any time, without informing its users.

5. Data Processing services

  1. Provider of the service on which the GeoChatbot is based, collects data regarding the performance and operation of the Service (“Service Data”) when Clients use the Service.
  2. The data supplied to the service is aggregated and anonymized. The Service Provider can freely use this information.
  3. The Service Provider holds all rights to the data provided, but shall not identify Clients or Users as the source of such data.
  4. Terms and Conditions of personal data processing by the provider of the service on which the GeoChatbot is based are available on the website: https://www.chatbase.co/legal/dpa.

6. Amendments to these Terms and Conditions

  1. GUGiK reserves the right to amend the provisions of these Terms and Conditions at any time.
  2. Amended Terms and Conditions will be published on geoportal.gov.pl and shall come into force on the date of their publication.
  3. Further use of GeoChatbot after publication of amended Terms and Conditions implies acceptance of such amendments.

7. Final Provisions

  1. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law and European Union law shall apply, including Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 laying down harmonised rules on artificial intelligence and amending Regulations (EC) No 300/2008, (EU) No 167/2013, (EU) No 168/2013, (EU) 2018/858, (EU) 2018/1139 and (EU) 2019/2144 and Directives 2014/90/EU, (EU) 2016/797 and (EU) 2020/1828 (Artificial Intelligence Act), Official Journal of the European Union of 12.7.2024, L 2024/1689.
  2. Any disputes related to the use of GeoChatbot shall be resolved by the competent common courts.
  3. By using GeoChatbot the User accepts these Terms and Conditions in full. In case of non-acceptance, the User should immediately stop using GeoChatbot.
